Description
The first line of the first page of the description should clearly state the name of the invention, which should be consistent with the name in the request form and should be centered. The name should not be prefixed with terms like “Invention Name” or “Name.” There should be a line space between the invention name and the main text of the description.
The format of the description should include the following parts, each with a title:
Technical Field
Background Technology
Content of the Invention
Description of the Drawings
Specific Embodiments
If there are no drawings, the description should not include the Description of the Drawings and its title.
Applications involving nucleotide or amino acid sequences should include these sequences as a separate part of the description. For electronic applications, a computer-readable sequence listing complying with the regulations should be submitted as a separate part of the description. For paper applications, a separately paginated sequence listing should be submitted, along with a copy of the computer-readable sequence listing in a format such as a CD or floppy disk. If the sequence listing on the submitted disk differs from that in the description, the listing in the description prevails. If the applicant fails to submit a copy of the computer-readable sequence listing, or if the submitted copy significantly differs from the listing in the description, examiners should issue a correction notification, requiring the applicant to submit the correct copy within a specified deadline.
The description may include chemical formulas, mathematical formulas, or tables, but illustrations should not be included.
If the description includes explanations of drawings, it should have drawings. If there are drawings, the description should include explanations of these drawings.
If the description part of the specification mentions accompanying drawings, but the specification either lacks the mentioned drawings or some are missing, the applicant should be notified to either cancel the references to the drawings in the description part of the specification or submit the corresponding drawings within a specified period. If the applicant submits additional drawings, the date of submission or mailing to the Patent Office will be considered the application date, and the examiner should issue a notification of re-determination of the application date. If the applicant cancels the corresponding drawing references, the original application date will be retained.
The specification should have its pages numbered in sequential order using Arabic numerals.
Drawings in the Description
Drawings in the description should be made using drawing tools, including computers, with uniform, clear, and sufficiently deep lines without alterations, and should not use engineering blueprints. Drawings are generally made with black ink. If necessary, color drawings can be submitted to clearly describe the related technical content of the patent application.
In sectional views, the sectional lines should not obstruct the clarity of reference lines and main lines.
Multiple drawings can be drawn on one sheet. A general view can be drawn on several sheets, ensuring each part on each sheet is independent, and when combined, they form a complete general view without affecting the clarity. Drawings should not have unrelated frames around them. If there are more than two drawings, they should be numbered sequentially using Arabic numerals, prefixed with “Fig.”, for example, Fig. 1, Fig. 2. This numbering should be placed directly below the corresponding drawing.
Drawings should be drawn vertically on the paper and clearly separated from each other. If a component’s horizontal dimensions are significantly larger than its vertical dimensions and must be arranged horizontally, the top of the drawing should be placed on the left side of the paper. If there are two or more drawings on one page, and one is already arranged horizontally, the others should also be arranged horizontally.
Drawing labels should use Arabic numerals. Labels not mentioned in the description text should not appear in the drawings, and labels not appearing in the drawings should not be mentioned in the description text. Labels indicating the same component in the application should be consistent.
The size and clarity of the drawings should ensure that all details are distinguishable when the drawing is reduced to two-thirds of its size, meeting the requirements for photocopying and scanning.
The same scale should be used throughout a single drawing. To clearly display a component, an additional enlarged partial view may be added. Drawings should not contain annotations other than necessary words. Words in the drawings should be in Chinese, and if necessary, the original text may be indicated in parentheses.
Flowcharts and block diagrams should be included as drawings and must contain necessary text and symbols within their frames. Generally, photographs should not be used as drawings. However, in special cases, such as displaying metallographic structures, tissue cells, or electrophoresis chromatograms, photographs may be used as drawings by attaching them to the paper.
The pages of the drawings attached to the specification should be numbered in sequential order using Arabic numerals.
